I did have a quick look at the VMware doco incase they changed since last
time I looked.

MAC OSX 10 is NOT listed as a guest OS.

Although there are some hacks out there and even a VM announced for  
this scenario its strictly forbidden by Apple. So a clear technical  
YES and a even clearer NO in the question of law.
